1. Introductory provisions
1.1. These terms and conditions regulate, in accordance with the provisions of § 1751 paragraph 1 of Act No. 89/2012 Coll., The Civil Code, the mutual rights and obligations of the parties which apply when purchasing online tickets to the Karel Zeman Museum and its accompanying programmes, when purchasing through the websites www.muzeumkarlazemana.cz and www.karelzemanmuseum.org.
1.2. The conditions further define and specify the rights and obligations of the Operator and the Customer.
1.3. These terms and conditions are governed by the laws of the Czech Republic.
2. How to buy a ticket
2.1. After selecting tickets of a specific price and category, the Customer is obliged to fill in the displayed electronic form and enter all the required information.
2.2. Once the payment has been made in the manner selected, a ticket confirmation page will be displayed. The Customer is also sent an e-mail informing them of the purchase of tickets to the e-mail address entered by him. It is necessary to provide the correct order number when entering the Karel Zeman Museum as it is when booking a programme.
2.3. The Operator does not guarantee the delivery of the e-mail message, as the server on which the Customer’s e-mail box is located does not have to accept the message, and may evaluate it as spam.
2.4. If the Customer does not present a printed ticket upon entry or does not provide the number of the paid order, he is not entitled to issue tickets or a refund.
3. Complaints
3.1. In accordance with the provisions of § 1837 letter j) of the Civil Code, the Customer may not withdraw from the purchase contract on the purchase of a Ticket in accordance with the provisions of Section 1829 of the Civil Code.
3.2. If during the ticket purchase process the amount for the purchase of tickets is debited from the Customer’s account, but the tickets are not displayed or sent to the specified e-mail, the Customer may file for a refund for non-provision at the bank that issued the payment card. These complaints will not be dealt with by the Operator.
4. Other rights and duties of the contracting parties
4.1 The Customer gains the ownership of goods upon the payment in full of the purchase price for the goods.
4.2. In relation to the Customer, the Operator is subject to no codes of conduct within the meaning of Section 1826, Paragraph 1, Subsection e) of the Civil Code.
4.3. The handling of consumer complaints is provided by the Operator via the electronic address eshop@muzeumkarlazemana.cz. The Opeartor will send information on the settlement of the Customer’s complaint to the Customer’s e-mail address.
4.4. The out-of-court settlement of Consumer disputes arising under the Purchase Agreement is in the jurisdiction of the Czech Trade Inspection Authority with registered office at Štěpánská 567/15, 120 00 Prague 2, Identification No. 000 20 869, www.coi.cz.
4.5. The Operator is authorized to sell goods under a trading license. Trade inspections are carried out by the trade licensing authority with the relevant jurisdiction. Supervision over the protection of personal data is carried out by the Office for Personal Data Protection. In addition, the Czech Trade Inspection Authority carries out limited supervision over compliance with Act No. 634/1992 Coll., on Consumer Protection, as amended.
4.6. The Customer hereby assumes the risk of a change in circumstances within the meaning of Section 1765, Paragraph 2 of the Civil Code.
5. Personal data protection
5.1. In case that the Customer is a natural person, the Customer’s personal data are protected under Act No. 101/2000 Coll., on Personal Data Protection, as amended.
5.2. The Customer agrees to the processing of the following personal data: name and surname, e-mail address and telephone number (“personal data”).
5.3. The Customer consents to the processing of personal data by the Operator for the purposes of exercising rights and fulfilling duties arising under the Purchase Agreement and for the purposes of maintaining the Customer’s user account. Unless otherwise indicated by the Customer, the Customer is also deemed to consent to the processing of personal data by the Operator for the purposes of sending information and commercial messages to the Customer. The consent to the processing of personal data, to the full extent thereof as granted under this article, does not constitute a prerequisite that would be conditional for the entry into the Purchase Agreement.
5.4. The Customer acknowledges that he/she has the duty to state accurate and truthful personal data (during registration, in his/her user account, while placing an order through the e-shop web interface), and that the Operator must be informed without unnecessary delay of any change in the Customer’s personal data.
5.5. The Operator may charge a third party, a processing agent, with processing the Customer’s personal data. Apart from persons responsible for the delivery of goods, the Operator shall never provide such personal data to third parties.
5.6. Personal data will be processed during an open-ended period. Personal data are processed in electronic form by automated means or in paper form by non-automated means.
5.7. The Customer certifies that provided personal data are accurate and that he/she has been instructed of the fact that personal data are provided on a voluntary basis.
5.8. If the Customer believes that the Operator or the processing agent (Article 9.5) processes his/her personal data in a way contrary to the protection of the Customer’s private and personal life, or in an unlawful manner, particularly if personal data are inaccurate in consideration of the purpose of the processing thereof, the Customer can:
5.8.1. request an explanation from the Operator or from the processing agent,
5.8.2. demand that the Operator or the processing agent rectify the relevant deficiency.
5.9. If the Customer requests information on the processing of his/her personal data, the Operator must provide thus requested information. For providing information as per the preceding sentence, the Operator has the right to charge commensurate compensation, which must not exceed the cost of providing such information.
6. Final provisions
6.1. These terms and conditions are valid as stated on the Operator’s website, on the day of the purchase of tickets by the Customer.
6.2. By purchasing tickets, the Customer unreservedly accepts all provisions of the terms and conditions and is irrevocably bound by them.
6.3. By purchasing tickets, the Customer also confirms his agreement with the internal rules of the Operator and is obliged to follow them.
